1. Acceptance of Terms

By accessing or using the Mapview mobile applications or our website (mapview.ai) (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms apply to all users of the Service, including users who browse, purchase and contribute content. Mapview Pty Ltd ("Mapview", "we", "us", or "our") reserves the right to modify these Terms at any time, with changes taking effect upon publication.

2. Description of Service

Mapview provides a mobile property intelligence application that aggregates and presents property data from various government and third-party sources. The Service includes:

  • Property search and mapping tools
  • Planning and zoning information
  • Title and document searches
  • Aerial imagery access
  • Site analysis tools
  • Planning permit data
  • Site alerts and notifications

3. Account Registration

Some features of the Service require you to create an account. You must:

  • Provide accurate, current and complete information during registration
  • Maintain and promptly update your account information
  • Keep your sign-in details secure — sign-in links and passwords are for you alone and must not be shared
  • Notify us immediately of any unauthorised use of your account
  • Be at least 18 years of age to create an account

You are responsible for all activity that occurs under your account. Mapview is not liable for any loss or damage arising from your failure to maintain the security of your account credentials.

4. In-App Purchases and Payments

4.1 Purchases

The Mapview app can be downloaded free of charge. Certain features, reports and data, including property reports, title searches and suburb reports, are offered as in-app purchases at the prices displayed in the app. We reserve the right to modify pricing with reasonable notice. Features that are currently free may become paid features in the future. Where that occurs, we will give you notice before the change takes effect, and the change applies to you only if you accept the new pricing (for example, by providing payment details or completing a purchase) or continue to use the relevant feature after the change takes effect. Reports and credits you have already purchased remain available to you.

4.2 Billing and Payment

In-app purchases are billed and processed by Apple App Store (for iOS) or Google Play (for Android) through your Apple ID or Google account. We do not store your payment card details. Any payment queries, disputes or refund requests relating to a store purchase should be directed to Apple or Google in accordance with the relevant store's policies. Store purchases are also governed by the terms of service of the applicable store (Apple Media Services Terms and Conditions or Google Play Terms of Service), which apply in addition to these Terms.

4.3 Cancellation and Refunds

Completed in-app purchases are generally non-refundable, except where required by Australian Consumer Law or where a refund is granted by Apple or Google under the applicable store policy. Credits purchased in the app do not expire.

4.4 Title and Document Purchases

Title searches and document orders are charged per transaction at the prices listed in the platform, and are typically delivered to your registered email address. Once a document has been retrieved from the relevant registry it is non-refundable, except where required by the Australian Consumer Law or where we could not provide the document.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws, regulations or third-party rights
  • Scrape, harvest or systematically extract data without prior written consent
  • Use automated systems to access the Service beyond personal use
  • Redistribute, resell or sublicence data obtained through the Service
  • Attempt to compromise the security or integrity of the platform
  • Use the Service for any unlawful purpose, including property fraud
  • Reproduce or publish data in a way that misrepresents its source or accuracy

6. Data Accuracy and Disclaimer

Mapview aggregates data from government sources including state land registries, planning authorities, and environmental agencies. While we endeavour to ensure the accuracy and currency of the data presented, we make no representations or warranties regarding the completeness, accuracy or fitness for purpose of any data.

You should not rely solely on Mapview data for significant legal, financial or property decisions without independent verification. Mapview strongly recommends that users obtain formal planning certificates, title searches and professional advice where significant decisions are involved.

6.1 No Professional Advice

Nothing in the Service constitutes professional advice of any kind. Content about planning, zoning, overlays, permits, titles, easements, covenants or property rights is not legal or planning advice, and price estimates and market data are not financial or valuation advice. Always obtain formal planning certificates, title searches and professional legal, financial or valuation advice before making significant decisions.

6.2 AI-Generated Content

Some features may use artificial intelligence or automated systems to generate content, such as plain-English summaries and scenario guidance. The availability of these features may change as the Service develops. AI-generated content may contain errors, omissions or outdated information and may not reflect the most recent planning amendments, legislation changes or council policies. You should independently verify any AI-generated content before relying on it.

7. Intellectual Property

The Service and its original content, features and functionality are owned by Mapview and are protected by Australian and international intellectual property laws. You may not reproduce, distribute, modify or create derivative works from any part of the Service without express written permission.

Data sourced from government registries and third parties remains the property of those respective sources. Mapview's compilation, presentation and value-added analysis is the intellectual property of Mapview.

8. Third-Party Services

The Service integrates with or links to third-party services, including government land registries and mapping providers. Mapview is not responsible for the content, availability or practices of third-party services. Your use of any third-party service is subject to that service's own terms.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

10. Limitation of Liability

To the maximum extent permitted by Australian law, Mapview shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data or goodwill, arising from your use of or inability to use the Service.

Mapview's total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to Mapview in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Mapview, its directors, employees, agents, and partners from any claims, damages, losses or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

Mapview may terminate or suspend your account and access to the Service at any time, without prior notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, Mapview, or third parties.

13. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria.

14. Australian Consumer Law

Nothing in these Terms is intended to exclude, restrict or modify any rights you have under the Australian Consumer Law. Mapview's services come with guarantees that cannot be excluded under Australian Consumer Law.
