Terms and Conditions

1. Acceptance of Terms

By accessing or using the Mapview platform, website (mapview.com.au), or mobile applications (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms apply to all users of the Service, including users who are browsers, subscribers and contributors of content. Mapview Pty Ltd ("Mapview", "we", "us", or "our") reserves the right to modify these Terms at any time, with changes taking effect upon publication.

2. Description of Service

Mapview provides an online property intelligence platform that aggregates and presents property data from various government and third-party sources. The Service includes:

  • Property search and mapping tools
  • Planning and zoning information
  • Title and document searches
  • Aerial imagery access
  • Site analysis tools
  • Planning permit data
  • Site alerts and notifications

3. Account Registration

Some features of the Service require you to create an account. You must:

  • Provide accurate, current and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorised use of your account
  • Be at least 18 years of age to create an account

You are responsible for all activity that occurs under your account. Mapview is not liable for any loss or damage arising from your failure to maintain the security of your account credentials.

4. Subscriptions and Payments

4.1 Subscription Plans

Mapview offers both free and paid subscription plans. Paid plans provide access to premium features as described in our pricing page. We reserve the right to modify pricing with reasonable notice to subscribers.

4.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorise Mapview to charge your nominated payment method for the applicable subscription fees.

4.3 Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation, you will continue to have access to paid features until the end of your current billing period. Mapview does not provide refunds for unused subscription periods, except where required by Australian Consumer Law.

4.4 Title and Document Purchases

Title searches and document orders are charged on a per-transaction basis at the prices listed in the platform. These transactions are non-refundable once the document has been retrieved from the relevant registry.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws, regulations or third-party rights
  • Scrape, harvest or systematically extract data without prior written consent
  • Use automated systems to access the Service beyond personal use
  • Redistribute, resell or sublicence data obtained through the Service
  • Attempt to compromise the security or integrity of the platform
  • Use the Service for any unlawful purpose, including property fraud
  • Reproduce or publish data in a way that misrepresents its source or accuracy

6. Data Accuracy and Disclaimer

Mapview aggregates data from government sources including state land registries, planning authorities, and environmental agencies. While we endeavour to ensure the accuracy and currency of the data presented, we make no representations or warranties regarding the completeness, accuracy or fitness for purpose of any data.

You should not rely solely on Mapview data for significant legal, financial or property decisions without independent verification. Mapview strongly recommends that users obtain formal planning certificates, title searches and professional advice where significant decisions are involved.

7. Intellectual Property

The Service and its original content, features and functionality are owned by Mapview and are protected by Australian and international intellectual property laws. You may not reproduce, distribute, modify or create derivative works from any part of the Service without express written permission.

Data sourced from government registries and third parties remains the property of those respective sources. Mapview's compilation, presentation and value-added analysis is the intellectual property of Mapview.

8. Third-Party Services

The Service integrates with or links to third-party services, including government land registries and mapping providers. Mapview is not responsible for the content, availability or practices of third-party services. Your use of any third-party service is subject to that service's own terms.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

10. Limitation of Liability

To the maximum extent permitted by Australian law, Mapview shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data or goodwill, arising from your use of or inability to use the Service.

Mapview's total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to Mapview in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Mapview, its directors, employees, agents, and partners from any claims, damages, losses or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

Mapview may terminate or suspend your account and access to the Service at any time, without prior notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, Mapview, or third parties.

13. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria.

14. Australian Consumer Law

Nothing in these Terms is intended to exclude, restrict or modify any rights you have under the Australian Consumer Law. Mapview's services come with guarantees that cannot be excluded under Australian Consumer Law.
